The Learning Reservoir Terms & Conditions

These Terms and Conditions govern your use of the Site. Please read them carefully before booking any eLearning course from the Site.

By booking purchasing an eLearning course you agree to accept without modification the Terms and Conditions
below. By viewing and using the Site you are deemed to consent to and accept the Terms and Conditions.

1.0 Changes to these Terms and Conditions

We reserve the right to change these Terms and Conditions at any time. Any changes are effective immediately upon posting to the Site. Your continued use of the Site constitutes your agreement to such Terms and Conditions.

2.0 Your Status

In order to purchase an eLearning course you must be at least 18 years old and you must be legally capable of entering into binding contracts.

3.0 Payment

The preferred method of payment for public training is debit/credit card for online bookings.

We are using 128-bit encrypted connection to protect any payments made on our website with SSL.

All prices quoted are subject to VAT regardless of customer’s geographical location. VAT is chargeable at the point of supply of the course and at the standard Irish rate.

Prices may be increased by the Learning Reservoir Ltd. at any time and customers will be given at least 14 days’ notice of any increase.

4.0 eLearning Courses

You will have access to the course material for a period of 6 months from the date of initial login. Course enrolment, fees and logon credentials are strictly non-transferable and non-refundable if the customer has logged onto the online portal at all, even for a limited amount of time.

Whilst The Learning Reservoir Ltd. endeavors to ensure that the information on the online platform is correct, we do not warrant the accuracy and completeness of the materials on the site, and we make changes to the e-learning/online content from time to time without notice. The Learning Reservoir Ltd. reserves the right to change or alter course content from that which is published to ensure it is up to date.

5.0 Liability and Disclaimer

To the maximum extent permitted by law, we provide the Site without any  warranties or guarantees. In particular, we do not warrant that the Site or any of its contents are virus free. You must take your own precautions in this respect, as we accept no responsibility for any infection by virus or other contamination or by anything, which has destructive properties. Although we do our best to provide constant, uninterrupted access to the Site, we do not guarantee this. We accept no responsibility or liability for any interruption or delay. The Site provides content from other sources and while we try to ensure that material included on the Site is  correct, we cannot accept responsibility if this is not the case. This disclaimer does  not affect your organisation’s statutory rights.

To the full extent allowed by law, you agree that The Learning Reservoir Ltd., its supplies, partners and their respective affiliates will not be liable to you for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or relating to the Site. 

You agree to defend, indemnify and hold the Learning Reservoir Ltd., its suppliers, partners and their respective affiliates free from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees and costs, in connection with:

  • your use of any services provided by the Learning Reservoir Ltd,;
  • your breach of these Terms and Conditions;
  • your breach of any third-party right, including any intellectual property right; or
  • any claim that the use of your data caused damage or loss to a third-party.

The indemnity obligation will survive the termination or expiration of your account and these Terms and Conditions.

6.0 Use of Material on the Website

For the purposes of this agreement, “material” includes, without limitation, text, video, graphics and sound material, published on the Site. You may download and print extracts from the material and make copies of these for your own personal and non-commercial use only. You are not allowed to download or print the material, or extracts from it, in a systematic or regular manner or otherwise so as to create a database in electronic or paper form comprising all or part of the material appearing on the Site. You may not broadcast, copy, download, frame, reproduce, replenish, post, transmit or otherwise use the material in any way except for your own personal use. Any other use of such material requires the prior written consent of the  Learning Reservoir Ltd.

You only agree to use our website, and associated services for completely lawful purposes, in a manner that does not infringe the rights of, restrict or inhibit the use or enjoyment of this site by any third-party. Prohibited behaviour includes but is not limited to defamation, damaging the security of our website, harassing or causing distress to any person, damaging content on our website, transmitting obscene or offensive content or anything which may affect the effective operation of our website.
To the full extent permitted by law, our website’s content is provided without any representations or warranties of any kind whether express or implied.

7.0 Privacy Policy

Your personal data will be collected when you interact with this website. By using this website, you consent to our Privacy Policy.

8.0 Miscellaneous

These terms and conditions are governed by and construed in accordance with the laws of the Republic of Ireland. The failure of the Learning Reservoir Ltd. to exercise or enforce any right or provision of these terms and conditions does not constitute a waiver of such right or provision. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms and Conditions to be unenforceable, the remainder of these Terms and Conditions will continue in full force and effect.

All disputes arising out of this Agreement will be subject to Irish law and the parties agree and submit to the personal and exclusive jurisdiction and venue of the Irish courts, except that nothing will prohibit the Learning Reservoir Ltd. from instituting an action in any court of competent jurisdiction to obtain injunctive relief or protect or enforce its intellectual property rights.
